TERMS AND CONDITIONS OF SERVICE

This agreement regulates the general purchase conditions of the different services offered in this website by VIRGINIA LYONS ENGLISH SCHOOL S.L. (from now on VLEC) with NIF number B22199210 and address in PLAZA ANDALUCIA N 7, 22004 HUESCA (SPAIN).

The CUSTOMER, when completing the purchase process of any of our services, explicitly accepts and submits to the clauses specified below, as well as the access conditions and use of our portal and its privacy policy, accessible through the link “Legal Notices” and “Privacy Policy”.

The CUSTOMER acknowledges that they have sufficient legal capacity to be contractually bound.

This contract is permanently accessible in the legal notice on our website, and can be downloaded in PDF format at the time of contracting.

IMPORTANT: By registering and purchasing the service you accept and give your consent that the provision of the service covered by the contract may begin before the expiry of the withdrawal period and, since the service consists of digital content provided through electronic media, the start of the provision of services will entail the loss of your right of withdrawal given the nature of the service (digital content) and in accordance with Article 103 point m of Spanish Royal Legislative Decree 1/2007, of 16 November, on the Defence of Consumers and Users.

The delivery of the service will begin when an e-mail is sent to you indicating the username and password to access the electronic platform where the digital content of your course is hosted and/or when you receive the timetabling and instructions for your examination.

Likewise, it should be born in mind that given the nature of certain services and in accordance with article 103 letter l) of Spanish Royal Legislative Decree 1/2007, of 16 November, on the defence of consumers and users, the right to withdrawal is not applicable if the contracts provide for a specific date or period of performance.

1. PRICES AND TAXES

In consideration for the service purchased, the CUSTOMER expressly agrees to pay VLEC the amounts specified at the time of purchase in the list of prices established on the website www.linguaskillaragon.es for the services chosen.

Once the selection of services has been completed and prior to confirming the order and before proceeding to pay for it, the final price of the purchase will appear on the screen, which will include, if applicable, administration costs, which will be reflected in the order form at the time of purchase and in the invoice, if requested.

Only what is specified in the description is included.

2. BOOKING PROCEDURE

Orders may only be placed via this website by individuals over the age of 16.

All our services are listed individually on the website. The procedure to make and manage the purchase is indicated on the website and you only have to follow the following steps:

  1. Choose the service you wish to purchase.
  2. Once you have selected a service, you will be able to process it by filling in a form with the details of the test and your personal details to formalise the purchase procedure.
  3. Next, the order will be verified, detailing the services selected and calculating the total price.
  4. It will also be necessary to indicate the personal details requested in order to process the service and, if applicable, issue the certificate at a later date.
  5. Once the personal details have been entered, it is necessary to tick a box to confirm that the terms and conditions of sale have been read and accepted.
  6. The website will provide the mechanisms for payment by credit or debit card.
  7. Once the payment details have been entered, you must confirm the order by clicking on the button “Book Exam”.
  8. Once the button has been clicked, the order confirmation will be sent by e-mail, along with the content and the steps to be followed, if applicable.

The CUSTOMER acknowledges that the photographs and descriptions of the services on the website are an approximate image of the services offered and may therefore differ from the original. The descriptions and illustrations of the services offered through this website are for information purposes only.

The CUSTOMER is informed that in the case of registering for an online examination (from home), it is the CUSTOMER’s sole responsibility to ensure that the computer which they are going to use to take the examination meets all the technical requirements necessary.

The CUSTOMER acknowledges that in the event of malpractice or any attempt to use unauthorised devices or breach of any examination regulations, VLEC reserves the right not to issue any results and to invalidate the examination in its entirety.

3. AVAILABILITY

The examinations and services offered on this website (linguaskillaragon.com) are available for purchase and completion anywhere in the world.

Orders will be processed once payment has been successfully received.

In order to keep you informed at all times of the management of your purchase, you will receive an e-mail notification of the confirmation of your order and payment and the information necessary to access the service.

4. PAYMENT AND PAYMENT PERIODS

We only accept payment by credit/debit card.

On completion of payment, you will receive confirmation by e-mail.

VLEC has no access to your credit/debit card details.

All our payment systems are completely secured.

Payments are made prior to the service being provided, therefore VLEC will not provide the requested service until payment has been received. VLEC reserves the right to temporarily or permanently cancel the services provided, in the event of any incident regarding the payment of the same.

The CUSTOMER is responsible for confirming receipt of the notifications and for informing us of any modification to their data, VLEC being exonerated from any responsibility derived from this circumstance.

6. WARRANTY

At VLEC we strive to provide services of the highest quality, although, given the nature of these services, we cannot offer a guarantee of satisfaction. In the event that, for any reason, you do not receive the service correctly, you should inform us as soon as possible indicating the incident and we will try, if the error is verified, to correct it as soon as possible.

7. REFUNDS

Due to the nature of the service covered by this contract, no refunds are possible.

8. RIGHT OF WITHDRAWAL

By registering and purchasing certain services you accept and give your consent that the provision of the service covered by the contract may begin before the expiry of the withdrawal period and, given that the service consists of digital content provided through electronic media, the start of the provision of services will entail the loss of your right of withdrawal given the nature of the service (digital content) and in accordance with article 103 point m of Royal Legislative Decree 1/2007, of 16 November, on the Defence of Consumers and Users.

The provision of the service will begin when an e-mail is sent with a pdf document indicating the exact time and place of examination corresponding to the service contracted.

Likewise, it should be borne in mind that given the nature of certain services and in accordance with article 103 letter l) of Royal Legislative Decree 1/2007, of 16 November, on the defence of consumers and users, the right of withdrawal is not applicable if the contracts provide for a specific date or period of performance.

In the latter case, if there is not a minimum number of attendees in the case of face-to-face examinations, the examination will be suspended and the CUSTOMER will be informed. Likewise, the CUSTOMER will be offered the option of choosing a new date and time at no cost or a full refund of the price paid.

In case of not attending the examination, VLEC will not refund the CUSTOMER.

9. PERFECTION OF THE CONTRACT AND MODIFICATIONS TO THE SERVICES

The present contract will be concluded with the payment of the service and the sending to the CUSTOMER of a confirmation e-mail with a description of the purchase made. VLEC reserves the right to modify in any way the characteristics and conditions of its services, always with the aim of improving them and in order to benefit the CUSTOMER.

10. PARTIES’ OBLIGATIONS

VLEC is committed to provide the CUSTOMER with the services that have been contracted, applying the maximum diligence in the provision of the service.

On-site examinations

VLEC is committed to the maintenance of the facilities necessary for the operation of the network, providing adequate technical and computer equipment for this purpose.
The CUSTOMER undertakes to use the services made available to them in good faith, without violating the laws in force in any matter or infringing the rights of third parties, as well as to pay for the selected service in the time and manner established in these terms and conditions of sale.

VLEC does not guarantee that the availability of the service covered by this contract will be continuous and uninterrupted, due to circumstances caused by problems in the Internet network, breakdowns in computer devices and other unforeseeable circumstances.

Therefore, the CUSTOMER agrees to accept these circumstances within reasonable limits, and therefore expressly waives any contractual or extra-contractual liability to VLEC for possible failures, errors and use of the contracted service.

Online examinations (from home)

VLEC will NOT be responsible for the CUSTOMER’s computer equipment or internet connection under any circumstances, so the CUSTOMER expressly waives the right to claim any contractual or extra-contractual liability from VLEC for possible failures, errors and use of the contracted service.

The CUSTOMER is responsible for providing the necessary equipment to take the examination from home, such as: computer hardware, smartphone (if necessary), headset with microphone and internet connection.

The CUSTOMER is responsible for ensuring that the computer, peripherals, accessories and software necessary to take the examination from home meet each and every one of the technical requirements to take the examination from home.

The CUSTOMER agrees to take the examination, without violating any examination regulations or using unauthorised electronic devices during the examination, as well as to pay for the selected service in the time and manner established in these terms and conditions of sale.

11. COMMUNICATIONS

All notifications between the parties should be made via e-mail. The CUSTOMER is responsible for confirming receipt of the notifications and for informing VLEC of any modification to their data, and VLEC will be exonerated from any liability arising from this circumstance. In the case of modification, the CUSTOMER must inform VLEC by e-mail or telephone numbers indicated on our website.

In compliance with Article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial mailings and information relating to our website and the services offered therein, will be sent by e-mail to the e-mail address you provide, always revocable. In any case, you have the option to reject our commercial communications by sending an e-mail to the address [email protected] indicating the word UNSUBSCRIBE in the subject line.

12. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

The CUSTOMER acknowledges having read and accepted the legal conditions of use and the privacy policy of the website.

The CUSTOMER acknowledges that they have understood all the information regarding the services offered on our website, as well as all the conditions and stipulations included in the present electronic contract, and therefore states that they are sufficient for the exclusion of error in the consent of the present contract, and therefore, they fully and expressly accepts them.

The CUSTOMER is fully aware that the acceptance and execution of the present contract will take place by means of providing their data and clicking on the “Register” button indicated on our website and that it will be perfected with the payment of the service.

13. APPLICABLE LEGISLATION

In the event of any dispute or difference of any kind between the parties in relation to the interpretation, content or execution of the Contract which is not resolved by mutual agreement, the Parties shall submit to the competent courts or tribunals.

14. PERSONAL INFORMATION

The contracting process requires you to fill in personal data forms for the purpose of processing and managing orders and, if you authorise it, to send you commercial information about our services. The provision of such personal data requires prior approval of our Privacy Policy.
